Axl Rose Loses Guitar Hero Lawsuit

According to The San Marino Tribune, Los Angeles Superior Court Judge Charles Palmer has dismissed the remainder of Axl Rose's lawsuit against Activision. Rose, lead singer from Guns 'N' Roses, filed the suit against Activision in 2010 for using a virtual likeness of Saul Hudson a/k/a Slash in Guitar Hero III. Rose also claimed that Activision asked him to lend "Welcome to the Jungle" to the game as long as the game would not include any likeness of Slash or Slash's new band, Velvet Revolver.

However, Slash's likeness heavily graced Guitar Hero III, appearing on the game's cover and as a playable character. In addition, the game did include songs from Velvet Revolver in its downloadable content.

To make up for this slight, Rose claimed that Activition promised him a band-specific title, Guitar Hero: Guns 'N' Roses. (On a serious note, would that have sold well?)

Last August, Judge Palmer dismissed Rose's fraud and misrepresentation allegations because they were filed past the statute of limitations. Activision's attorneys filed a motion to dismiss for the rest of the allegations, which were for Rose's claims of a contract. After two hours of listening to both sides' arguments, Judge Palmer agreed that the contract claims should also be dismissed.
