[UPDATE: Sega Denies] Lawsuit Filed Against Gearbox And Sega For Aliens: CM

[UPDATE]: Sega and Gearbox have issues statements regarding this lawsuit and it appears as though both parties believe the case will end in their favor. Sega said to Kotaku that they "cannot comment on specifics of ongoing litigation, but we are confident that the lawsuit is without merit and we will defend it vigorously." Gearbox also told the site that "attempting to wring a class action lawsuit out of a demonstration is beyond meritless. We continue to support the game, and will defend the rights of entertainers to share their works-in-progress without fear of frivolous litigation."

In the suit, found by Polygon, the representing law firm of Edelson LLC writes that "Each of the 'actual gameplay' demonstrations purported to show consumers exactly what they would be buying: a cutting edge video game with very specific features and qualities." The suit continues to state that "their 'actual gameplay' demonstration advertising campaign bore little resemblance to the retail product that would eventually be sold to a large community of unwitting purchasers."

Who should compensate the gamers who bought Aliens: Colonial Marines day 1? How much should each slighted gamer get? It's amazing to me that anyone wondered why Sega was pulling out of console-game development and focusing on mobile. First the PlayStation and now Gearbox? What's with everyone dicking Sega over?
