Earlier this year a U.S. court decided that Nvidia will be paying a hefty price for its dishonesty regarding the GTX 970's included memory. This was spurred by mass controversy of what at the time was the best selling GPU in history. Although sold as having 4GB of GDDR5, in actuality it only had 3.5GB of GDDR5, while the other 0.5GB was much slower memory.
It has taken months for everything to move into a state where consumers can claim their reward from the settlement, but the time has finally arrived. A new website has been published specifically for the case, and it explains the options for GTX 970 owners who purchased their GPU prior to August 24th as the following:
This is the only way to receive a Cash Payment. By submitting a claim, you will give up any rights to sue Defendants separately about the same legal claims in this lawsuit.
Exclude Yourself from the Class by November 8, 2016
If you opt out of the settlement, you will not be eligible to receive a Cash Payment, but you will keep any rights to sue Defendants separately about the same claims alleged in this lawsuit.
Object or Comment by November 8, 2016
You may write to the Court about why you do, or do not, like the settlement. You must remain in the class to comment in support of or in opposition to the settlement.
Appear in the Lawsuit or Attend a Hearing on December 7, 2016
You may ask to speak in Court about the fairness of the settlement. You may enter your appearance in Court through an attorney at your own cost if you so desire.
Do Nothing
If you do nothing, you will receive no Cash Payment. You also give up your right to sue Defendants on your own regarding any claims that are part of the settlement.
